What is Sabka Vishwas (Legacy Dispute Resolution) Scheme, 2019
Sabka Vishwas (Legacy Dispute Resolution) Scheme, 2019 is an amnesty scheme lodged in Finance Act 2019 (No. 2). It is a Tax Dispute Resolution scheme boldly introduced by the Prime Minister Shri Narendra Modi Government to unload the baggage relating to the past taxes viz. Central Excise and Service Tax that have been subsumed under Goods and Services Tax and allow business people to make a new beginning and focus on GST to address the unclosed disputes in Central Excise and Service Taxes.
The CBIC gives an opportunity of voluntary disclosure to non-compliance taxpayers. This scheme shall come into force from 1st September, 2019 as per the Notification No. 04/2019 Central Excise-NT Dt. 21st August, 2019 and Taxpayers has to submit their application on or before 31st December 2019 as per Sabka Vishwas (Legacy Dispute Resolution) Scheme, 2019 Rule No. 3. And this scheme closes on 31st December 2019 as per Circular No. 1071/4/2019-CX.8 Dt. 27th August 2019.
List of Indirect Tax Enactments application for the Scheme.
Section 122 of Finance Act 2019 deals with the indirect tax enactments to which this scheme is applicable. This Scheme shall be applicable to the following enactments, namely
- the Central Excise Act, 1944 or the Central Excise Tariff Act, 1985 or Chapter V of the Finance Act, 1994 and the rules made thereunder;
- the following Acts, namely
- the Agricultural Produce Cess Act,1940;
- the Coffee Act, 1942;
- the Mica Mines Labour Welfare Fund Act, 1946;
- the Rubber Act, 1947;
- the Salt Cess Act, 1953;
- the Medicinal and Toilet Preparations (Excise Duties) Act, 1955;
- the Additional Duties of Excise (Goods of Special Importance) Act, 1957;
- the Mineral Products (Additional Duties of Excise and Customs) Act, 1958;
- the Sugar (Special Excise Duty) Act, 1959;
- the Textiles Committee Act, 1963;
- the Produce Cess Act, 1966;
- the Limestone and Dolomite Mines Labour Welfare Fund Act, 1972;
- the Coal Mines (Conservation and Development) Act, 1974;
- the Oil Industry (Development) Act, 1974;
- the Tobacco Cess Act, 1975;
- the Iron Ore Mines, Manganese Ore Mines and Chrome Ore Mines Labour Welfare Cess Act, 1976;
